Christchurch District Plan 

A District Plan sets out a council’s long-term policies for land use and gives rules and guidance for land and building development. It determines how areas in the district are zoned for particular types of use – residential, commercial, industrial and rural – and regulates the types of activities that are allowed to occur at properties.

After the 2011 earthquake, an Order in Council was put in place by the Government to set out a fast track District Plan review process, and the District Plan was reviewed and updated under an Independent Hearings Panel. Subsequent legislation prevents us from changing the Christchurch District Plan until June 2021. It is expected that the Order in Council will be revoked early in 2019, so changes to the District Plan will once again be possible.

Woolston Risk Management Area

Much of Woolston is zoned for industrial activities. One of these activities is the storage and distribution of bulk fuel, an important lifeline for the city in the event of an emergency, such as a significant earthquake. At present we have two risk management areas relating to the bulk fuel storage terminals in Chapmans Road, Woolston. The risk management areas, or the overlays, are defined areas around the two bulk storage terminals. Their purpose is to manage the risks to people at nearby properties from the storage, use, distribution and disposal of hazardous substances at the site. They also aim to ensure that activities at nearby properties don’t compromise the terminals.

Proposed change

Until now, risk management areas (overlays) for these two sites have fallen under a rule in the Christchurch District Plan that has a sunset clause, which will expire at the end of March 2019. The purpose of the sunset clause was to give the bulk fuel storage terminal operators time to complete quantitative risk assessments that were required by the Independent Hearings Panel on the Christchurch Replacement District Plan in March 2016. The risk assessments have now been done.The change we propose is to combine the two risk management areas, so there will be just one, the Woolston Risk Management Area. The area covered by the proposed new overlay will also change, in line with the risk assessments (see maps).

We would need to make the following changes to the District Plan:
• Update the geographic area covered by the proposed single Woolston Risk Management Area; change the names of the two risk management areas to Woolston Risk Management Area; and remove the sunset clause
• Update the industrial policy relating to the bulk fuel storage terminals
• In the Industrial General Zone, change the status of preschool activity (a sensitive activity) within the proposed Woolston Risk Management Area from permitted to non-complying.

Next steps

Feedback
We welcome feedback, as this helps ensure we haven’t missed something and helps us prepare for more formal consultation. At this stage we are engaging with people considered to be directly affected by the proposal.

Notification
Any change to the District Plan needs to be by public notification or limited notification. In this case, we can’t notify the change until the Order in Council has been revoked by the Government.

Consultation
There will be an opportunity for people affected by a proposed change, or anyone who has an opinion on it, to make a formal submission for or against the proposal.
