Proposed Christchurch Replacement District Plan

Extension of period for making submissions on Coastal Hazards and Coastal Environment Provisions

1. The period for making submissions on Stage 3 Proposals on the proposed Christchurch Replacement District Plan expires on Friday 4 September 2015. The Chair of the Independent Hearings Panel has extended the period for making submissions on the coastal hazards provisions of the Stage 3 Natural Hazards Proposal and all of the Coastal Environment Proposal. This extension has been made by the Chair under clause 5 of Schedule 3 of the Christchurch Earthquake (Christchurch Replacement District Plan) Order 2014.

2. The extension of the period for making submissions is specific to the following provisions only:
Proposal 5, Natural Hazards
(a) 5.0 Introduction Coastal Hazards;
(b) 5.2.9 Policy - Changing Climate;
(c) 5.6 Policies for coastal hazards (5.6.1 Policies for coastal erosion and sea water inundation and 5.6.2 Policies for coastal hazard mitigation works);
(d) 5.11 Coastal erosion and coastal inundation rules (Rules 5.11.1, 5.11.2, 5.11.3, 5.11.4, and 5.11.5); Proposal 19, Coastal Environment
(e) All of Proposal 19: Planning Maps
(f ) All Planning Maps which include the “Coastal Zone”, the “Coastal Environment” notation, Coastal Erosion Management Areas 1 and 2, and Coastal Inundation Management Areas 1 and 2; and
(g) All Natural hazard Planning Maps which include Coastal Erosion management Areas 1 and 2, and Coastal Inundation Management Areas 1 and 2.

3. The following persons may make a submission on the proposals:
(a) the Christchurch City Council; and
(b) any other person unless that person could gain an advantage in trade competition through the submission, in which case the person may make a submission only if the person is directly affected by an effect of the proposal that—
(i) adversely affects the environment; and
(ii) does not relate to trade

4. Submissions on the provisions listed above will now be accepted until Friday 16 October 2015. Those submissions will be published on 2 November 2015. The period for further submissions will be from 2 to 16 November 2015.

5. The proposals described above may be inspected during normal opening hours at any of the Council’s Service Centre offices and libraries. For details of your nearest service centre please telephone (03) 941 8999. The proposals may also be viewed and downloaded from the Council’s website proposeddistrictplan.ccc.govt.nz(external link).

6. To lodge a submission send a written or electronic submission in the prescribed form to the Christchurch City Council at:

7. All submissions must:
(a) identify the relevant proposal and the specific provision in that proposal that the submission relates to. Where a submitter is submitting on more than one provision a separate submission point must be made for each provisions;
(b) specify the decision that the submitter seeks for each submission point. Where a decision seeks an amendment to a provision the amended wording sought must be specified; and
(c) state whether or not you wish to be heard.

8. The process for public participation in the consideration of the proposals described above under the Christchurch Earthquake (Christchurch Replacement District Plan) Order 2014 is as follows:
(a) after the closing date for submissions, Christchurch City Council will publish all submissions and give notice of the availability of the submissions and where the submissions can be inspected; and
(b) there must be an opportunity for the following persons to make a further submission in support of, or in opposition to, the submissions already made:
(i) any person representing a relevant aspect of the public interest; and
(ii) any person who has an interest in the proposal greater than the general public has; and
(iii) the Minister for the Environment and the Minister for Canterbury Earthquake Recovery; and
(iv) the Christchurch City Council.
(c) the Christchurch City Council will publish the further submissions on its website.
(d) the Independent Hearings Panel will call pre-hearing meetings for the proposals as soon as practicable after the date on which the further submissions are published. At a later date the Independent Hearings Panel will hold a hearing and make decisions on submissions to the Stage three proposals; and
(e) the following persons have the right to appeal to the High Court against the decision of the hearings panel but only on a question of law:
(i) a person who made a submission on a provision or matter that is the subject of the appeal; and
(ii) the Minister for the Environment and the Minister for Canterbury Earthquake Recovery; and
(iii) the Christchurch City Council
